Agency role and acceptance
Except where otherwise specified, SmartVision Limited Company, doing business as Galapagos Dream Travel, a Virginia company with an office at 13800 Coppermine Rd, Herndon, VA 20171 USA ("Galapagos Dream Travel," "we," "us," or "our"), acts only as a booking agent for travel arrangements and other services we take or make on your behalf ("Arrangements"). Your contract for an Arrangement is with the independent cruise line, tour operator, carrier, hotel, local operator, or other supplier responsible for it (the "Supplier/Principal"). We do not own, operate, manage, or control those Arrangements.
By using this website, submitting an inquiry, or asking us to make a booking, you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the website or our booking services. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
By making a booking with us, the first named person on the booking agrees on behalf of all persons detailed on the booking that they:
- have read these Terms and agree to be bound by them;
- consent to our use of personal information under our Privacy Policy and are authorized to provide the personal information of every person named on the booking, including, where applicable, health, disability, accessibility, dietary, or religious information needed for the requested Arrangements;
- are at least 18 years old and have authority to make the booking and accept these Terms for the party;
- where a traveler is under 18, have authority as that person's parent, legal guardian, or authorized adult to include them in the booking and accept responsibility for their compliance with these Terms; and
- accept financial responsibility for the booking on behalf of all persons detailed on it.
1. Contract
When making a booking, we arrange for you to enter into a contract with the applicable Supplier/Principal identified on your confirmation. We are not responsible for the acts, omissions, financial condition, or performance of a Supplier/Principal. Your booking is subject to these Terms and the terms, conditions, policies, and restrictions of each applicable Supplier/Principal.
We will provide or link to the Supplier/Principal's terms as soon as reasonably practicable, and you should read them carefully before authorizing a booking or payment. Those terms may limit liability and impose separate payment, cancellation, change, health, conduct, or dispute requirements. If supplier terms are provided only after confirmation and you object to them, notify us within 48 hours so we can ask the Supplier/Principal about available options. Any cancellation or refund remains subject to applicable law and the Supplier/Principal's terms.
Your booking and contract with the Supplier/Principal exist only when we send a confirmation on its behalf. A website submission, saved trip, quote request, cabin request, payment attempt, or automated acknowledgment is not a confirmed booking. Prices and availability remain subject to Supplier/Principal confirmation. If these Terms conflict with a Supplier/Principal's terms on a matter concerning its Arrangements, the Supplier/Principal's terms control for that matter; these Terms continue to govern our own booking service.
2. Booking details and traveler information
Check all names, dates, routes, cabins, and timings immediately upon receipt of any quote, invoice, or confirmation and tell us promptly about errors. Names must match the relevant passport. Corrections or later changes remain subject to the applicable Supplier/Principal's terms.
Information you provide may be passed to the Supplier/Principal and other persons necessary to quote, reserve, or provide the Arrangements, and to customs, immigration, park, port, security, or other authorities as required. This may include sensitive information you choose to provide about accessibility, disability, health, dietary, or religious requirements. If we cannot disclose information reasonably necessary for an Arrangement, we or the Supplier/Principal may be unable to provide it. See our Privacy Policy for more information.
3. Payment
To request your chosen Arrangements, you must pay the deposit or full payment required by the Supplier/Principal. The amount due today depends on the operator's policy and the time remaining before departure, and is shown before you submit payment. The confirmed all-inclusive trip price is the amount due for the Arrangements; we do not add a separate agency or booking surcharge.
If you pay a deposit, the remaining balance must be received by the due date stated on your invoice or confirmation. If full payment is not received on time, the Supplier/Principal may cancel the booking and impose the cancellation charges in its terms. Except where we advise otherwise or the Supplier/Principal's terms state otherwise, money you pay to us for an Arrangement is received on behalf of the Supplier/Principal and forwarded under our agreement with it.
Online card payments are processed by Authorize.net using its browser-side tokenization service. Complete card numbers and card security codes are sent directly to Authorize.net and are not sent to or stored on our servers. We may also provide payment instructions or a secure payment link after confirming availability. Do not send payment credentials by contact form, website assistant, email, text message, or WhatsApp.
By submitting a payment through an approved channel, you authorize the applicable charge, represent that you are permitted to use the payment method, and agree to provide accurate billing information. Payments are not final until successfully processed and accepted. A processor or financial institution may decline or screen a transaction, place a temporary authorization hold, or require additional verification. We are not responsible for their processing delays.
If your financial institution converts a payment into another currency, that conversion occurs outside this website and does not change the confirmed U.S.-dollar trip total. Before initiating a chargeback, please contact us so we can review any billing issue. Refunds are subject to the Supplier/Principal's terms and ordinarily returned to the original payment method; processing time is controlled by the processor and financial institutions.
4. Prices
Advertised prices, schedules, inclusions, and availability may change, and errors may occur. We and the Supplier/Principal may correct a price or content error before booking confirmation. If a material pricing error is discovered after confirmation, we will notify you and explain the options available under the Supplier/Principal's terms and applicable law.
Prices are quoted in U.S. dollars and are per person based on the stated occupancy. Displayed prices are all-inclusive for the listed package and include all required taxes, government charges, park and transit charges, and booking costs. We do not add a mandatory surcharge to the displayed total. Promotions, discounts, and credits may have separate eligibility, capacity, combination, and expiration restrictions.
5. Insurance
We and our suppliers require adequate travel insurance where stated in your quote, confirmation, or the Supplier/Principal's terms, and strongly recommend it in all cases. Coverage should be appropriate for cancellation, interruption, emergency medical care and evacuation, repatriation, baggage, supplier insolvency, and the activities and destinations involved. Insurance terms, exclusions, and claim decisions are controlled by the insurer. If you travel without required or adequate coverage, we are not responsible for losses that would otherwise have been covered.
6. Special requests and accessibility
Tell us before booking about dietary, mobility, medical, accessibility, room, or other special requests. We will communicate requests to the Supplier/Principal but cannot guarantee they will be met unless the Supplier/Principal confirms them in writing. You are responsible for determining, with appropriate professional advice where needed, whether the itinerary and activities are suitable for each traveler.
7. Changes and cancellations by you
Cancellation or amendment requests must be sent to us in writing by email and take effect when received and acknowledged during our business hours. Obtain written confirmation of any approved change before travel. While we will try to assist, a request is not effective until accepted by the applicable Supplier/Principal.
Changes and cancellations are governed by the Supplier/Principal's terms and may affect the refundable amount, generally more significantly closer to departure. Some Arrangements do not permit changes. We do not add a separate administration charge for a change or cancellation.
8. Changes and cancellations by the Supplier/Principal
We will notify you as soon as reasonably possible if a Supplier/Principal significantly changes or cancels confirmed Arrangements. We will communicate available alternatives, credits, or refunds offered by the Supplier/Principal, but we do not control those options or the timing of payment. Your remedies are governed by the Supplier/Principal's terms and applicable law.
9. Supplier responsibility and events beyond control
Suppliers are independent contractors, not our employees or agents in providing the Arrangements. Tickets, vouchers, receipts, and confirmations are issued subject to each Supplier/Principal's terms. We do not own, operate, manage, supervise, or control any vessel, aircraft, vehicle, hotel, restaurant, guide service, or other travel service.
To the fullest extent permitted by law, we are not responsible for delay, schedule change, loss, injury, damage, or other failure caused by a Supplier/Principal, traveler, or event beyond our reasonable control. Such events may include severe weather, natural disaster, fire, epidemic or pandemic, quarantine, wildlife or environmental conditions, labor dispute, government or port action, war, terrorism, civil unrest, transportation failure, utility or communications outage, cyberattack, or changes to medical, customs, immigration, or park rules. We are not responsible for lost or stolen items.
We may refuse or discontinue service where reasonably necessary for safety, unlawful conduct, nonpayment, abuse, or material breach of these Terms. Our responsibility as booking agent is limited to using reasonable care in carrying out your booking instructions and communicating information received from the Supplier/Principal.
10. Limitation of liability
To the fullest extent permitted by law, Galapagos Dream Travel and its officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or opportunity, arising from the website, our booking service, or any Arrangements, even if advised that such loss may occur. Any liability arising from our own booking service is limited to the extent permitted by applicable law.
These limitations do not apply to liability that cannot lawfully be limited, or to our fraud, gross negligence, willful misconduct, or liability for death or personal injury caused directly by us where such exclusion is prohibited. Supplier/Principal liability is governed by its contract and applicable law.
11. International travel, safety, passports, visas, and health
International and expedition travel involves inherent risks, remote locations, changing conditions, and possible delays or itinerary substitutions. By offering an Arrangement, we do not represent that travel to a destination is advisable or risk-free. Review current government travel advisories and Supplier/Principal safety information and make your own informed decision.
You are responsible for checking and satisfying all passport validity, visa, transit, immigration, vaccination, health, insurance, customs, park, and entry requirements for every traveler and destination, including requirements based on citizenship, residence, age, and itinerary. Requirements change; verify them with the relevant embassy, consulate, government authority, medical professional, and Supplier/Principal in sufficient time. We are not responsible if a traveler is denied boarding or entry or incurs loss because requirements were not met.
12. Complaints
Report a problem with an Arrangement immediately to the Supplier/Principal or its local representative so it has a reasonable opportunity to investigate and address the issue. After travel, direct complaints about an Arrangement to the Supplier/Principal identified in your confirmation and copy us if you want assistance communicating with it.
Complaints about our booking service should be sent to reservation@galapagosdreamtravel.com. Please submit a complaint promptly and, where reasonably possible, within sixty (60) days after the relevant service so records can be reviewed. This notice request does not shorten any mandatory limitation period or waive a right that cannot lawfully be waived.
13. Indemnification
To the extent permitted by law, you will indemnify and hold us and our officers, directors, employees, and agents harmless from third-party claims, liabilities, damages, and reasonable costs arising from your material breach of these Terms, your violation of applicable law, or information or instructions you provide without required authority. This section does not require you to indemnify any person for that person's own negligence, willful misconduct, or violation of law.
14. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules, and applicable federal law. Subject to any non-waivable consumer right to bring a claim elsewhere, the state and federal courts serving Fairfax County, Virginia will have exclusive jurisdiction over disputes between you and Galapagos Dream Travel concerning our website or booking service. Before filing a claim, each party agrees to give the other written notice and a reasonable opportunity to resolve the dispute informally. Nothing prevents either party from seeking relief in an eligible small-claims court or urgent injunctive relief where appropriate.
15. Accommodation ratings and standards
Ratings are provided by the relevant Supplier/Principal or local rating body as a general guide. Standards, categories, facilities, and services vary by country and supplier, and we cannot guarantee that a rating will match a traveler's expectations.
16. Website, documentation, and third-party content
Descriptions and other content we provide about an Arrangement are based on information from the Supplier/Principal and present only a general description. Not every detail can be included, and all services are subject to availability and change. Contact us before booking if a particular feature is important to you.
Trip data, schedules, maps, images, prices, and availability may change or contain errors. We may correct or update website content without notice. Links to Supplier/Principal or other third-party sites are provided for convenience; we do not control and are not responsible for their availability, security, content, or practices. The website assistant provides general website information and may make mistakes; it does not confirm availability, create a booking, or provide legal, medical, or professional advice.
17. Acceptable use and intellectual property
The website and its original text, design, graphics, software, trademarks, and compilation are owned by or licensed to Galapagos Dream Travel and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use the website for personal, non-commercial travel planning.
You may not copy or commercially exploit the website; scrape or access it through unauthorized automated means; bypass security or usage limits; introduce malicious code; interfere with operation; impersonate another person; submit unlawful, infringing, deceptive, or abusive material; attempt to obtain confidential prompts, credentials, or non-public data from the website assistant; or use the site in violation of law. We may block access or remove submissions where reasonably necessary to protect the service, users, or others.
18. Privacy and electronic communications
Our Privacy Policy explains how we handle personal information. You consent to receive booking and service communications electronically at the contact details you provide. Electronic communications and signatures may satisfy legal writing and signature requirements to the extent permitted by law. Marketing messages are optional and may be stopped as described in the Privacy Policy.
19. General terms
We may update these Terms prospectively by posting a revised version and changing the date above. The Terms in effect when a booking is confirmed will continue to govern that booking unless a change is required by law or agreed in writing. If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent; we may assign ours in connection with a reorganization, sale, or transfer of our business. Headings are for convenience only. These Terms, the written booking confirmation, applicable Supplier/Principal terms, and any written terms expressly incorporated into them form the entire agreement concerning their subject matter and supersede prior discussions about that subject matter.
